The Foreigner's Work Permit is a legal document for foreigners to work in China.
WORK PERMIT CATEGORY
Establish a scientific and practical evaluation system for foreign talents, pay attention to ability, performance and contribution, and highlight market evaluation, international peer evaluation and other market demand-oriented (see the description of recognized career achievement standards for foreign high-end talents, hereinafter referred to as the description of achievement standards). A comprehensive application of the point counting system (see the score and assignment table of the elements of the points), the work guidance directory for foreigners in China, labor market testing and quota management will be divided into three categories of foreigners working in China, A, B and C, and classified management will be implemented according to the standard.
Category A: Foreign high-end talents
Category B: Foreign professionals
Category C: Other foreign personnel
WHAT ARE THE CONFITIONS ?
(1) The basic requirement of the employing company
1. Established according to law, no record of serious violations of law and dishonesty; The positions employed by foreigners should be those with special needs, which are temporarily short of suitable candidates in China and do not violate the relevant regulations of the State; The wages and salaries paid to the foreigners employed shall not be lower than the local minimum wage standards;
2. If laws and regulations stipulate that the industry competent authorities shall pre-approve, approval shall be required.
(2) The basic requirement of the applicant
1. Must be at least 18 years of age, in good health, no criminal record, have a confirmed employer in the territory, and have the necessary professional skills or appropriate level of knowledge for their work;
2. The work is in line with the needs of China's economic and social development, and is an urgent domestic shortage of professionals;
3. If laws and regulations provide otherwise for foreigners to work in China, such provisions shall prevail.
(3) Foreign high-end Talents (Category A)
Foreign high-end talents refer to those scientists, leading scientific and technological talents, international entrepreneurs, specialized and special talents who meet the requirements of "advanced, sophisticated and outstanding" and market demand-oriented, and are required by China's economic and social development, as well as those who meet the standards of foreign high-end talents. Top foreign talent is not limited by age, education or work experience.
(4) Foreign professionals (Category B)
Foreign professionals refer to those who meet the work guidance directory and job requirements of foreigners in China, are in urgent need of economic and social development, have a bachelor's degree or above, two years or more of relevant work experience, and are under the age of 60; If there is a real need for innovative and entrepreneurial talents, professionals with professional skills, outstanding foreign graduates, foreign professionals who meet the standards for scoring points, and the implementation of intergovernmental agreements or agreements, restrictions such as age, education or work experience can be appropriately relaxed.
(5) Other foreign personnel (Category C)
Other foreign personnel refers to other foreign personnel who meet the needs of the domestic labor market and comply with the provisions of national policies.
(6) Approval shall be granted if the following conditions are met
(1) It falls within the scope of the authority of the administrative department for the work of foreigners;
2. Meet the above conditions for foreigners working in China;
3. The application materials are true, complete and meet the requirements.
(7) Approval shall not be granted under any of the following circumstances
1. Incomplete application materials;
2. The application materials do not meet the requirements;
3. False application materials;
4. The applicant does not meet the working conditions in China;
5. Other circumstances in which it is not appropriate to issue work permits to foreigners in China.
There is no limit on the number of foreign high-end talents (Category A); Foreign professionals (Category B) limited according to market demand; The restriction on the number of other foreign personnel (Category C) shall be implemented in accordance with relevant national regulations.
POSSIBLE PENALITIES FOR ILLEGAL EMPLOYMENT
Possible penalties for illegal employment:
According to Article 80 of the Exit and Entry Administration Law of the People's Republic of China, foreigners who illegally work will face the following penalties:
(1) Aliens who illegally work shall be fined between 5,000 yuan and 20,000 yuan;
(2) Aliens who illegally work, if the circumstances are serious, shall be detained for not less than 5 days but not more than 15 days and fined not less than 5,000 yuan but not more than 20,000 yuan.
(3) Individuals who introduce foreigners to illegal employment shall be fined 5,000 yuan for each person illegally introduced, and the total amount shall not exceed 50,000 yuan; The unit shall be fined 5,000 yuan for each person illegally introduced, and the total amount shall not exceed 100,000 yuan; If there are any illegal gains, the illegal gains shall be confiscated.
(4) Those who illegally employ foreigners shall be fined 10,000 yuan for each person illegally employed and the total amount shall not exceed 100,000 yuan; If there are any illegal gains, the illegal gains shall be confiscated.
